Darkbloom divides our policies in 2 categories: Private and Professional Individual/Group. Each client will sign the respective release agreement prior to receiving photos.
Private Individual Contract
Terms and Agreements
I, _________________________________________________ agree to the following as initialed.
________ I, _________________________________________________ represent _________________________ as a private individual and from here on will be referred to as Client. If represented is a person(s) under 18 years of age, I Client, am parent or guardian of said represented and terms apply to both Client and Represented. Darkbloom Imagery, related and affiliates will be referred to as solely Darkbloom Imagery.
________ Client is 18 years of age or older.
________ Client does not hold Darkbloom Imagery, Darkbloom Studios, Darkbloom Imagery online (website and networking websites), Lolita Haze, LolitaHaze.com, owner(s), photographer(s), and/or other business and personal relations responsible for any damages, physical, mental, emotional, spiritual, liable, slander, resulting from photo shoot and agreed upon terms below.
Darkbloom Imagery (and affiliates) image usage and Client Privacy.
_______ Darkbloom Imagery and affiliates reserve full rights to all images.
_______ Privacy and respect of Client is important to Darkbloom Imagery. No image of Client will be shown, displayed, or used without written expressed permission of Client.
_______ In the event of Darkbloom Imagery wanting to use Client image for, but not limited to; portfolios (online and hard copy print), advertisement and promotions (online ads, print ads, film/video/digital ads, radio ads), product examples – compensation will be in the form of free additional image for usage of that image or a discount of final payment for use of selected image. Client will sign a separate release of image form for agreed upon image.
_______ Although Darkbloom Imagery reserved all rights to usage of Client images Darkbloom Imagery will not use Client images respectively for products or promotions intended for promotion without written permission from Model.
_______ Images will NOT be allowed to be used, traded, bartered or sold to 3rd parties for the intent of non Darkbloom Imagery promotion or merchandise/items intended for sale or distribution. Darkbloom Imagery will never sell Client’s personal Images for financial gain.
Client usage and distribution rights of images that include Client.
_______ Client has limited rights to images.
_______ Client may use (post or print) only final edited images for personal use and sharing (online or hard copy print).
_______ Darkbloom Imagery allows Client to print only final edited images for personal use and sharing not intended for trade, barter, or sale. Photo prints, business cards, personal party/event flyers, personal event postcards, and specialty items (mugs, magnets, stickers, ect) not intended for sale are okay. Personal use only.
________ Client will not loan, trade, barter, sell or allow usage of final edited images to 3rd parties intended for promotion or intent of distribution and manufacturing items for sale or gain.
_______ In the event of 3rd party interest, 3rd party must request written permission of release from Darkbloom Imagery.
Licensing (For Professionals Only)
_______ A one-time licensing fee of 100$ will be applied to each final edited photo shoot images set for final edited images intended for the distribution and manufacturing of items intended for personal sale and financial gain. Such items include, but not limited to 8x10 prints, large format prints, specialty items, magnets, buttons, and t-shirts, secure membership pay websites all intended for sale and financial gain and distribution.
Image Selection, Images Received and Turn Around Terms
________ Unedited, watermarked, low resolution image proofs will be available at session or online for Client to make image selection from.
________ Unedited low resolution proofs cannot be reposted, reproduced, or printed by Client.
________ Client will make selection of proof images in the number included in package along with 2 alternative selections. Darkbloom Imagery reserves the right to exchange alternative images for first choice selections in the event that files become corrupt or cannot be properly edited.
_______ Client will only receive selected final edited images and will not receive any raw or unedited images/out-takes. Final edited images will be emailed to Client in print size of 8x10 inches and web-size of 1024px. All images will be watermarked with the Darkbloom Imagery logo and cannot be removed and or disturbed in anyway.
_______ Emailed images need to be saved by Client within 30 days and then become the responsibly of Client. Darkbloom Imagery is not responsible for lost or damaged images after 30 days of email confirmation.
_______ Client will receive 8x10 prints of each image and can be mailed or picked up. Darkbloom Images is not responsible for prints lost in the mail. Darkbloom Imagery will only release prints for pickup to Client unless otherwise signed off person.
_______ I, Client, give Darkbloom Imagery permission to release prints for pickup to ___________________________.
_______ Turnaround time will be around 14 days , but could take up to 30 days. Rush fees may apply for images need before the 14 days.
Additional Fees
________ Additional costs for special costumes or props and Client requested venue fee/rental may apply and will be at the cost of the Client.
________ If it is necessary for Darkbloom Imagery to travel to Client, a travel fee of $50.00 may apply for first 50 miles and an additional $1.00 for every mile thereafter.
Payments
________ Package selection must be made when booking date and time.
________ 50% of initial total must be made at time of photo shoot. This portion becomes nonrefundable at the time of photo shoot.
________ Remainder of total will be paid at time of print image release and email images (for printing and posting) will not be sent until final images are signed off. At which time final payment becomes nonrefundable.
________ At time of proof selection, additional images can be purchase for $20.00 each. Automatic upgrades will be made if upgraded package is less expensive than additional images.
________ Darkbloom Imagery only accepts Paypal payments, and cash payments. PayPal payments will be sent to LolitaHaze1@gmail.com and will show receipt to LolitaHaze.net or LolitaHaze.com. Cash payments must be hand delivered. An itemized receipt will be given at each interval.
________ Additional prints and products can be ordered after final payment is made for images. Payment must be received in full before order is processed. Additional shipping and handling charges may apply if product is shipped from Darkbloom Imagery to Client. Client can make a scheduled in person pickup once Darkbloom Imagery receives Clients product(s).
